Lori Vallow Lost Her Lawyer in a Hearing She Couldn’t Attend

Lori Vallow Daybell’s appeal reached the Idaho Supreme Court on November 2nd. The case turns on whether Judge Steven Boyce violated her constitutional right to the lawyer of her choice when he removed Mark Means in December 2021. Means was taken off the case in a hearing held in Chad Daybell’s case number. Lori was in a state hospital and had been found too sick to help in her own defense. The justices asked sharp questions about the conflict. Chad was paying Means. Means told a court he represented both Daybells. A jail call between the Daybells has Chad calling Means his lawyer. Lori’s appellate lawyer admits Means never properly objected at the removal hearing. That forces her best claim through the toughest standard in appellate law. If she wins, the death penalty could come back. Bob Motta on whether this appeal has legs.
