Lindsay Clancy Was ONE Juror Away From Not Guilty

Lindsay Clancy is being held at Tewksbury State Hospital, and the murder charges are the only criminal case keeping her there. On November 2nd, 2026, her lawyers asked Judge William Sullivan to dismiss those charges in the deaths of her three children in Duxbury, Massachusetts. If he does, Eric Faddis explains who decides whether she stays at Tewksbury or could end up living on her own.
Faddis, a defense attorney and former prosecutor, joins me to go through the Lindsay Clancy mistrial motion. Her trial ended in September 2026 with eleven jurors ready to find her not guilty by reason of insanity and one holdout. Clancy’s lawyers argue Sullivan should have questioned that juror instead of ending the trial, and that a retrial would be double jeopardy.
Sullivan also had six alternate jurors who heard the full trial, and he didn’t seat one. Clancy’s lawyers say that choice is why the charges have to go. Sullivan hasn’t ruled.
