Lindsay Clancy: Two Courtrooms, WHAT Legal Risk?!

Lindsay Clancy left the first criminal trial without a verdict. Eleven jurors favored finding her not guilty by reason of insanity; a lone holdout disagreed, and Judge William Sullivan declared a mistrial. At the November 2 hearing, the defense asked to end the prosecution on double-jeopardy grounds. Prosecutors indicated they expect to retry the case, but Assistant District Attorney Jennifer Sprague would not pin down whether that means first-degree murder or lesser charges. Sullivan said he would revisit the motions November 16 and discussed a possible spring trial.
Meanwhile, there is a separate dispute over words that may or may not ever be spoken under oath. Patrick Clancy has brought a wrongful-death suit against mental-health providers who treated Lindsay before the deaths of their children, Cora, Dawson, and Callan. His attorney, Howard Cooper, told a judge he believes Lindsay will testify she expressly warned providers about homicidal thoughts toward the children. Lindsay’s criminal attorney, Kevin Reddington, rejected that account the same evening. He said she did not tell providers that, has not agreed to testify, and is not represented by Patrick’s lawyer.
The providers are seeking dismissal of the civil suit, arguing in part that Massachusetts law limits their duty to warn or protect others when no explicit qualifying threat has been communicated. That is a legal argument, not a judicial finding of fault or innocence. Lindsay also has a separate civil action alleging problems with her treatment.
Bob Motta joins Tony Brueski and Robin Dreeke to unpack why a criminal lawyer would be watching a civil hearing so closely. What happens when a proposed witness’s words are described before she has agreed to take the stand? And how much can a prosecutor decide before the court rules on dismissal? The answers have to come from the record, not a confident headline.
