Walls of Silence: The Strategic Refusals to Speak in Clancy, Birchmore, and Kepner

Published by Tony Brueski on

DA Tim Cruz has not said whether Lindsay Clancy faces a second trial. Eleven of twelve jurors sided with the defense, and the one who didn’t had a restraining order against him during the trial. Patrick Clancy has remarried and called a retrial extraordinarily painful. In the Anna Kepner case, Timothy Hudson’s lawyers told a federal judge one unresolved issue is holding up the plea — and they won’t say what it is. The trial date has been postponed three times. Hudson’s own mother refused to take him home after the cruise. And in Sandra Birchmore’s federal murder trial, the forensic injuries prosecutors allege have no documented parallel. The FBI pulled tens of thousands of texts local investigators never recovered. The department that gave officers unsupervised access to Sandra when she was twelve has never been formally investigated. Three cases. In each one, someone with the power to answer won’t.
