Richard Allen and the Five Words Indiana Didn’t Want to Hear
The State of Indiana’s proof that Richard Allen was treated well in solitary is a short list: a free replacement tablet, a new cell window, and a couple of in-person visits with his wife. The state’s lawyer read it to the Indiana Court of Appeals on September 21, 2026, in the Delphi murders appeal, and the warden’s 2023 account explains the tablet. Allen destroyed the first one in the days after the phone call in which he told his wife he killed Abby and Libby, while refusing to eat or sleep.
That call was April 3, 2023. She hung up on him. The state counted 61 incriminating statements after that, to his mother, to guards, to the warden, and to the prison psychologist, and it had a record of every one because the suicide-watch cell logged everything he said every fifteen minutes.
Sworn statements from Westville guards confirm they used a Taser on Allen twice in May 2023, for refusing orders, they say. When his lawyers asked to move him because guards wore patches tied to Odinism, the state admitted the patches were real, said the officers were told to remove them, and called a transfer unwarranted.
Allen wants a new trial because his lawyers say those thirteen months produced the confessions and the trial court hid the evidence that undercut them. The state wants the conviction upheld because it says restrictive housing isn’t coercion under Indiana law and the confessions that matter came when he was lucid.
The appeals judges asked the state whether Allen was treated as well as anyone else at Westville. The answer was yes. What a judge said next is the first thing you’ll hear. No ruling has come, none is scheduled, and the loser can take it to the Indiana Supreme Court.
