How Charlie Kirk’s Prosecutor Damaged His Own Case

The death-penalty prosecutor in the Charlie Kirk case got himself held in contempt of court — and the trial hasn’t even started. Tyler Robinson faces aggravated murder charges for the September 2025 shooting that killed Kirk at Utah Valley University. By every measure, the prosecution’s case should be overwhelming. Alleged confessions in a handwritten note, text messages, and a Discord post. DNA evidence linking Robinson to the rifle. Surveillance footage placing him on the rooftop. A voluntary surrender facilitated by his own parents.

But the prosecution couldn’t leave the evidence alone. After the defense highlighted an inconclusive ballistics report — the bullet fragmented and couldn’t be matched to the rifle — the county attorney’s spokesperson went on a media tour. TMZ. USA Today. Fox News. He corrected misinformation about the ballistics, which was permitted. Then he told TMZ prosecutors had “ample evidence” to overcome the presumption of innocence. That was not permitted. The judge held him in civil contempt and ordered the prosecution to pay the defense’s legal costs.

The prosecutor’s misstep is just one failure in a case defined by them. Kirk’s security team warned the university about rooftop exposure two weeks before the event. Six campus officers covered a crowd of more than 3,000. The first person arrested was a false confessor whose phone contained illegal material unrelated to the case. The FBI director announced the wrong suspect. And Robinson was ultimately identified not by the investigation but by his mother and father, who recognized their son in publicly released surveillance photos.
