Kevin Reddington Is Challenging the Mistrial HOW?!
Kevin Reddington is challenging what happens next in the Lindsay Clancy case before prosecutors have committed to a retrial. The September 29 hearing now brings together two separate defense attacks on the aftermath of the 11-1 hung jury.
One route is Massachusetts Rule 25. That rule permits a judge to enter a required finding of not guilty when the evidence is insufficient as a matter of law. The other route is a double-jeopardy argument. Reddington says the mistrial lacked manifest necessity because jurors reported that the lone holdout acknowledged doubt but still would not join the majority.
The jury instructions make that dispute harder to reduce to a simple story about one stubborn juror. Judge William Sullivan told the panel it had to accept the law as he gave it, whether jurors agreed with it or not. The deadlock charge also told them that each verdict had to be the product of the individual juror’s own convictions. It then reminded them that a defendant must receive the benefit of any reasonable doubt.
During deliberations, Reddington asked Sullivan to remove the holdout. The judge declined, explaining that discharging a deliberating juror requires extreme caution and that the record did not show the juror had stopped deliberating or refused to obey the law. The trial ended in a mistrial on September 4 after more than 38 hours of deliberations across seven days.
Defense attorney Bob Motta breaks down where these arguments overlap and where they do not. The next question is whether Sullivan sees a legal basis to end the case, or whether the Commonwealth gets another chance to present it to twelve new jurors.
