Elizabeth Siders Faces 23 Counts as Gary’s Case Stalls

The Siders family case now has one defendant the court says cannot be tried and another facing 23 criminal counts while her own competency remains unresolved. Gary Siders Sr., 73, was found incompetent to stand trial on September 9 after a forensic examiner concluded he could not understand or assist in the proceedings. The judge also accepted the finding that he is not restorable, leaving prosecutors to choose between dismissal and possible civil commitment. 

Gary Sr. had been charged with 16 counts of child endangerment after 16 children were found June 30 in a Hamden, Ohio, home. He had already been released on a recognizance bond because of serious medical concerns and is subject to GPS monitoring. His attorney has said he expects the criminal case to be dismissed, but that decision still belongs to prosecutors and the court. 

Elizabeth Siders is on a different track. She faces 19 child-endangerment counts plus four additional felony charges involving a teenage relative, and she pleaded not guilty to the newer charges on September 16. Her bonds total $550,000. Her attorney requested a competency evaluation, and the report had not yet been filed at the time of her arraignment. 

The other remaining defendants, Gary Siders Jr. and Christina Siders, also asked to be evaluated for competency. So the same prosecution that began with four adults and 16 children is now being filtered through four separate mental-competency questions.
