Lindsay Clancy’s Providers Now Face Two Lawsuits

The criminal trial ended in a mistrial. The civil lawsuits are just beginning. Patrick Clancy and Lindsay Clancy have both filed suit against the medical providers who treated Lindsay before the January 2023 deaths of their children Cora, 5, Dawson, 3, and Callan, 8 months. Both lawsuits name the same defendants — psychiatrist Dr. Jennifer Tufts, nurse practitioners Rebecca Jollotta and Julie Paul, Aster Mental Health, and South Shore Health.
Patrick’s wrongful death complaint alleges his ex-wife was prescribed eight psychiatric medications in a three-week span. Lindsay’s malpractice suit alleges undiagnosed Bipolar I disorder with postpartum onset and a course of uncoordinated polypharmacy that triggered a psychotic break.
The criminal trial at Plymouth Superior Court produced five weeks of conflicting psychiatric expert testimony. The jury deadlocked eleven to one and could not resolve the competing diagnoses.
Bob Motta of Defense Diaries examines the providers’ exposure, what the mistrial does to the civil cases, and why the only courtroom likely to examine the medication timeline under oath may now be the civil one.
